Prosecutor Wants to Revoke Bail of Raw Milk Farmer

by Jerry Bader

Yes, this is vindictive. I have said that I don't like the tactic of jury nullification and obviously prosecutors are upset that it worked here, which I believe it did. But this move to revoke bail would seem to indicate that this has become personal for prosecutors. And that's every bit as distasteful as jury nullification. To want Hershberger held without bail until he's sentenced on the one charge on which prosecutors did get a conviction is absurd. There's no indication he's a flight risk.

The three not guilty verdicts were a huge victory for the legalization of raw milk sales. It was also a stunning defeat for the prosecution. One they need to get over.
