WAUSAU, Wis. (WSAU) – An illegal immigrant charged with killing a high school senior in her Wausau apartment this spring may have to find a new lawyer.
Raul Ponce-Rocha’s attorney has asked to withdraw from the case. Gene Linehan filed the motion Monday.
In an affidavit, Linehan said Ponce-Rocha has failed to pay him a retainer fee despite several requests.
The court will likely set a hearing on the motion.
Linehan’s withdrawal could put a two-week jury trial in February in jeopardy since Ponce-Rocha’s new attorney would have to get caught up to speed on the case.
Prosecutors believe Ponce-Rocha beat and stabbed 18-year-old Breanna Schneller in her west side Wausau apartment May 2nd. They say tests link his DNA to crime scene evidence.
