WAUSAU, Wis. (WSAU) – Wausau’s former engineer has filed a $1.8 million dollar lawsuit against the city to get his job back.
Dale Lehman filed the civil lawsuit in Marathon County circuit court April 5th. The city has 45 days to respond or else a judge could grant a default judgment in Lehman’s favor.
Neither city attorney Anne Jacobson nor Lehman's attorney, Thomas Molinaro, returned calls for comment Monday.
The lawsuit claims the city violated the terms of a 2004 settlement agreement with Lehman when it laid him off November 30th. City officials claim Lehman and three other employees were laid off for budget reasons.
The complaint seeks $1.8 million in lost wages, health insurance, retirement and Social Security benefits, and vacation time. The total amount in damages could rise based on what kind of documents both sides uncover in the discovery process.
If Lehman is successful in his suit, the agreement he reached with the city in 2004 requires that the city pay his legal fees.
