STEVENS POINT, Wis (WSAU) A woman who worked as an administrative assistant to Portage County executive Mark Maslowski is suing, claiming she is owed 43-thousand dollars in unpaid overtime. Heidi Born-Smith says the Portage County didn't keep accurate records of her work hours, and that she regularly worked more than 40-hours per week. She was Maslowski's assistant from 2006 to 2010, when he lost his reelection bid. Her lawsuit also seeks attorney's fees.
Some Portage County leaders believe the position is exempt from the state's overtime laws.
A county committee had earlier denied a notice of claim in the case.
The matter has now been referred to Portage County's insurance firm. Their lawyer in Milwaukee is reviewing the case, and will determine if there will be a settlement or if the matter will be fought in court.
