UNDATED (WSAU) A judge in Waukesha County will hold a hearing July 20th on a legal challenge to the law which seeks to eliminate Indian team names from Wisconsin public schools.

Youth football program leader Craig Vertz and Rusty Schoolcraft filed a lawsuit last fall, after the state Department of Public Instruction ordered Mukwonago High School to drop its “Indians” name. The plaintiffs say the law is unconstitutional. They claim the D-P-I shows a bias against school districts once a resident complains to the state about an Indian team name.

Vertz and Schoolcraft said the law disfavors schools and their taxpayers – and they said there was no way the Mukwonago district could have won its defense of the “Indians” name once the case went to the state.

Democrats passed the new law in 2010, after Indians complained for years that school team names discriminate against them. Assembly Republican Steve Nass of Whitewater drafted a bill last fall to repeal the measure. But it hasn’t been brought up in the Legislature yet. And its chances of passing could sharply diminish if Democrats win back the majority in the Senate after this summer’s recall elections.
