State wants collective bargaining lawsuit dismissed

MADISON (WRN) The Department of Justice on Friday filed motions to dismiss a lawsuit challenging passage of the budget repair bill. The lawsuit is based on claims the conference committee that approved the collective bargaining bill violated the open meetings law.

The motions seek to have Republican lawmakers, the conference committee, and the Legislature removed as defendants in the case. It also states the entire lawsuit should be dismissed because the four Republicans targeted have immunity from civil actions while the Legislature is in session.

The briefs also argue the judge does not have the authority to interfere with the legislative process.

Implementation of the budget repair bill remains on hold because of a temporary injunction issued by Dane County Judge MaryAnn Sumi. The case has been delayed since April, as both sides prepare arguments on how to proceed.
