West lockdown suspect waives preliminary hearing Tuesday

WAUSAU, WI  (WSAU)  -  The man accused of causing the Wausau West school lockdown by threatening a student was in court Tuesday.

18-year-old Marcos L. Garza was to have a preliminary hearing at three-o-clock, but he waived his right to that hearing. Prosecutor Theresa Wetzsteon says there have been no deals reached in Garza’s case.  "We constantly negotiate in cases, but in this case, we haven't set it for a plea or reached any kind of negotiation of that kind.”  

Wetzsteon says both sides will now prepare for the next court appearance.  "We have to provide discovery to the defense at this point, since they don't have all the reports and that will be provided.  Then we'll discuss the case further."

Garza’s next appearance will be a pre-trial hearing on November 19th and then an arraignment hearing the following day.

Marcos Garza was arrested Friday, October 5th on Jefferson Street in downtown Wausau carrying a loaded handgun in his backpack. He’s charged with threats to injure, threaten injury or harm by computer message, and carrying a concealed weapon. He is also accused of taking indecent videos of the victim and using them to control her actions. Garza could spend least five years in prison if convicted.
