WAUKESHA, WI (WTAQ) - A state appeals court said a waitress was not paid her minimum wage when she worked at a Racine County restaurant.
On Thursday, the court said Shawn Johnson of Waterford is entitled to more than the $10,000 she was originally awarded to pay her legal fees.
Johnson sued the Roma Italian restaurant, saying she was underpaid in violation of both state and federal minimum wage laws.
She asked for $112,000 for both unpaid wages and legal fees. And the Second District Appellate Court in Waukesha said it did not know why a circuit judge awarded so much less than what Johnson requested.
The case was sent back to the Racine County Circuit Court for a new determination of damages.
