State justice department asks for Act 10 lawsuit delay

MADISON (WSAU-Wheeler News)  The state Justice Department has asked a Madison judge to delay action on an Act-10 union lawsuit filed by the Wisconsin Law Enforcement Association. The state says it makes no sense to move forward with the case, while the State Supreme Court reviews a similar lawsuit filed by two other unions. The Justice Department says the Supreme Court’s decision will probably dictate the legal arguments in the suit from the law enforcement group – so it makes sense to wait.

The case is now before Dane County Circuit Judge John Markson.

On June 14th, the Supreme Court said it would review another lawsuit on the public union bargaining limits, and decide whether they apply to local government and school unions. That suit was filed by Madison Teachers Incorporated and a Milwaukee city employee union. A circuit judge sided with the unions and said Act-10 was unconstitutional – but it was never made clear whether the decision applied to local unions statewide, or just the parties that filed the suit.
