Nuisance Ordinance fails to pass Stevens Point council


STEVENS POINT, Wis. (WSAU) -- A proposed nuisance ordinance did not pass Stevens Point’s city council Monday night.

The planned ordinance would have given police the authority to penalize property owners if police were called to disturbances or other problems three times. Many landlords have been speaking out against the proposal, urging city officials to penalize the problem tenants and not the landlords calling for help.

One of them was David James. He said, “Nuisance activity should not include an activity where a residential property owner has made a call to the police, and while I understand that there’s some concern that tavern owners or other commercial businesses could use that loophole, I think in the residential context it makes good sense to encourage premises owners to contact the police.”

During the past couple of weeks, City Attorney Andrew Beverage worked with interested property owners to add a good faith clause, where landlord cooperation and police discretion would put fines on tenants instead of landlords.

The city council first voted down a motion to defeat the ordinance, and then voted down a motion to pass it. Mike Phillips voted against both motions and tried to have it moved to a future meeting. Mayor Andrew Halverson ended the discussion noting the two failed votes.

It will be up to the mayor if this issue comes back on the December agenda.
