Marathon County to issue same-sex marriage licenses starting Thursday


WAUSAU, Wis. (WSAU) -- Same sex couples will be able to get marriage licenses in Marathon County starting Thursday. County Clerk Nan Kottke says barring any further legal developments, her office will start issuing the licenses at 8:00 a.m.

Kottke says it’s only fair to begin issuing the licenses, especially now that the state has started processing them.  “It’s fairness to the rest of the rest of the same-sex couples that are receiving from other counties that are issuing them.”

Marathon County’s Clerk says to her, the ruling by Judge Crabb and the lack of court action afterwards made her decision simple.  “It is undisputed that the effect of Judge Crabb’s ruling will be to remove the remove the ban from issuing licenses to same-sex couples, and no federal court has yet put a stay on that. Wisconsin county clerks throughout the state have been issuing licenses, and at this point, the majority of the county clerks have begun issuing them.”

Kottke says couples will need the appropriate documents and a marriage ceremony scheduled to get the license. Kottke says she does not have requirements like some county clerks do for waiving the five-day waiting period to get married. She says you can pay the $25.00 fee and get married right away.

The 7th Circuit Court of Appeals ordered both sides of the issue to submit briefs by 5:00 p.m. Wednesday. So far, no action has been taken. Federal Judge Barbara Crabb, who made last Friday’s ruling against the gay marriage ban, will hold a hearing Friday to consider staying her order.
