MADISON, WI (WSAU) — A Dane County Judge has blocked an attempt from two outside groups to join a lawsuit that seeks to remove Wausau dentist Fred Prehn from the state’s Natural Resources Board after the expiration of his term in May.
The decision means Republican lawmakers in Madison and Kansas-based Hunter Nation will not be allowed to join the proceedings.
The suit was filed by Attorney General Josh Kaul in August, asking a judge to remove Prehn as the chair of the NRB. Prehn has refused to leave his post even though his term expired months ago, saying he will wait to vacate the seat until lawmakers confirm his replacement- Sandra Naas.
Naass was appointed by current Governor Tony Evers and would give Evers’ appointees control of the board. Prehn was appointed by former Governor Scott Walker. Lawmakers have made no move towards voting on Ness’ appointment.
Republicans in the Senate had asked to be included in the suit because they have a role in confirming gubernatorial appointees. Hunter Nation had claimed that decisions made by the board impact its Wisconsin members.
Lawmakers have asked for an appeal of the decision. In the meantime, Prehn remains on the board. The group didn’t meet this month because according to the DNR there were no items that required discussion. Prehn said he feels the decision was made because he has refused to vacate the seat.
