WAUSAU, WI (WSAU) — Sentencing did not happen as planned on Friday for a 41-year-old Marathon County man accused of sexual assault of a child.
Court records indicate Phillip Henle has requested a new attorney and to withdraw his no contest plea to one count of second-degree sexual assault of a child. But during a hearing on Friday, he indicated that he’s changed his mind and would like to retain his current attorney.
Charges stem from a July 2019 investigation involving a then 12-year-old girl who told her mother and stepfather that she had been assaulted by Henle, and that he had made her “pinky promise” to not tell anyone.

Judge Rick Cveykus will consider those motions during a hearing on October 6th. Henle faces up to 40 years in prison and $100,000 in fines for the Class C felony, but those penalties could increase because he is a repeat offender.
He’s currently serving time in the Wisconsin prison system for possession of meth, THC, and other drug paraphernalia.
