WAUSAU, WI (WSAU) — The man accused of tailgating a vehicle along US Highway 51 and then shooting at the family inside is not competent for trial.
That’s the findings after a competency evaluation was completed on 41-year-old Bennie Green, who is facing charges of attempted homicide and recklessly endangering safety from the October incident.
Court records show that the state, the court, and Green agreed he wasn’t fit for trial.
Green is accused of tailgating another vehicle as the two were driving north on US 51 in early October. According to the victim, Green had been slowing down and speeding up, allowing their vehicle to pass and then tailgating. Green is then accused of driving alongside the victims and shooting twice into their vehicle. He then led officers on a chase that ended back in the Wausau area where he was arrested after a Lincoln County deputy disabled his vehicle.
Five people were in the vehicle at the time of the incident. One person was injured but recovered.
Additional charges against him include OWI, being a felon in possession of a firearm, and fleeing an officer.
Green had requested to represent himself in the case with a standby attorney. Trial proceedings have now been suspended, and a review hearing is scheduled for February 26th.
