STEVENS POINT, Wis. (WSAU) — Both sides are preparing for a legal water fight on Stevens Point’s northeast side. The Town of Hull claims Stevens Point’s new high capacity municipal well #11 between Highway 66 and the Stevens Point Airport has caused problems for Hull residents that have been forced to drill new wells or make repairs since the city well went into service.
City Attorney Andrew Logan Beveridge says they have received some but not all documentation on the Town of Hull’s legal action against them. “The City of Stevens Point has received a Notice of Circumstances of Claim, and a claim from the Town of Hull related to well #11. They’re alleging that the well has drawn down their groundwater and caused harm to its residents. We’ve also received Notices of Circumstances of Claims from multiple individuals. We have not yet received the claims themselves.”
Beveridge says he will be working with a legal specialist to defend the city in the complex case. “The council approved a letter of engagement that will bring attorney Paul Kent from the Stafford Rosenbaum firm onboard to assist the city in defending that case.”
Beveridge says the city will benefit from having attorney Kent working with him on this matter. “Well #11 is a very expensive piece of infrastructure, and in my opinion, it would be best for the city to bring in somebody who is an expert in that particular field of law.”
So far, it’s early in the case and not all documents have been filed.
