MADISON, WI (WTAQ) — The head of the MacIver Institute wants the State Supreme Court to stop sitting on their hands.
Brett Healy appeared on WTAQ’s ‘The Morning News with Matt and Earl’ and called on the state Supreme Court to make a decision on whether or not Governor Tony Evers is legally allowed to issue back-to-back extended COVID-19 emergency orders and mask mandates.
“We’re still sitting here in March waiting for a decision from the state Supreme Court on the governor’s executive powers,” Healy said. “Because they have not acted, we’re lurching back and forth here between Governor Evers having complete control and the legislature trying to rein him in a bit.”
Late last year the State Supreme Court heard oral arguments in the case, but they have yet to issue a decision on the matter.
Healy says it’s not likely that the legislature will be able to get Evers to sign any of their legislation targeting such powers.
“Hope springs eternal,” said Healy. “But I would think that any restriction on his ability, in his mind, to manage a crisis like this he is not likely willing to sign that.”
The State Assembly is forwarding several bills to that effect.
