MADISON, WI (WSAU) – A former state Supreme Court justice said the legislature should “seriously consider” decertifying the fall 2020 election results. Michael Gableman testified in front of the assembly’s Elections Committee today, saying there were widespread irregularities in voting and vote counting.
Other legal experts say decertifying results after a meeting of the Electoral College to pick the new President would be illegal.
Gableman had said earlier that his report was not intended to overturn the presidential election.
The text of Gableman’s report does not recommend decertification, but his comments to lawmakers said it should be considered. An appendix to his report suggested how lawmakers could reject election results and choose their own set of electors.
The report also recommends dismantling the Wisconsin Elections Commission, which he claims issued guidance that was contrary to state election law. He cited allowing ballot drop boxes and voting irregularities in nursing homes as examples. The report also included video interviews with nursing home residents. Some were unable to state their names, but still cast ballots. One patient said staff forced her to cast a ballot, telling her “she had to.”
The report was also critical of cities that accepted funding from the Mark Zuckerberg-backed Center for Tech and Civic Life, which steered most of its donations to five Wisconsin cities to assist in administering the election. Mayors in Green Bay and Madison refused to testify, despite being subpoenaed.
Gableman said his findings are an interim report, and that his investigation is ongoing.
