WAUSAU, WI (WSAU) — David Anselmo has been sentenced to eight years in prison and 10 years of extended supervision for killing his friend while handling a gun during a night of drinking in 2019.
Judge Gregory Huber handed the sentence down on Friday after numerous victim impact statements were made. Anselmo himself also spoke during the sentencing hearing. He did give the 22-year-old credit for nearly three years already served in the Marathon County jail.
Charges stem from a 2019 incident in which a group was passing a handgun during a graduation party. After it was passed to Anselmo, he said examined it to see if it had a bullet in the chamber. As he was pulling the slide back, his hand slipped and his finger accidentally pulled the trigger. The shot struck and killed 19-year-0ld Trey Wilcox.
The magazine was taken out of the weapon at the time of the shooting.
Conditions of his extended supervision include no contact with the victim’s family and maintaining absolute sobriety from drugs and alcohol.
Anselmo had initially been charged with first-degree reckless homicide in the case, but the charge was reduced to one count of homicide by intoxicated use of a firearm as part of a plea deal that was reached back in February.
A second count of operating a firearm while intoxicated was dismissed but read in, meaning Judge Huber could consider it in his sentencing.
