MADISON, WI (WTAQ-WRN) – State Department of Justice attorneys will review materials and hold moot court practice, as they prepare for a May 4th hearing challenging Wisconsin 1849 abortion law.

“Our key argument is that there were a series of laws that were passed following Roe versus Wade, that regulate legal abortion and that those laws are inherently in conflict with the 1849 ban, which is a sweeping ban with very limited exceptions.”
Kaul, (on ‘UpFront’ Sunday) said those laws impliedly repealed the 1849 ban. Initial oral arguments will be held in Dane County Court.
The case is expected to eventually come before the Wisconsin Supreme Court, where the election of Janet Protasiewicz gives liberals majority control.
