WASHINGTON D.C. (WSAU) – Jack Smith, special counsel, has suggested dropping four charges against Donald Trump, the president-elect, for allegedly taking part in the incident at the US Capitol on January 6.
According to the New York Post, Smith asked the court to withdraw his office’s case against the 45th and soon-to-be 47th president, citing Trump’s victory in the 2024 presidential election and precedent against indicting a sitting US president.
“It has long been the position of the Department of Justice that the United States Constitution forbids the federal indictment and subsequent criminal prosecution of a sitting president,” Smith stated in the filing.
In addition to conspiracy against rights, Trump was also charged with conspiracy to defraud the United States, obstruction of and attempt to impede an official proceeding, and conspiracy to obstruct an official proceeding.
