STEVENS POINT, WI (WSAU) — A jury trial scheduled for late January is off for Christian Emerson after the 19-year-old pled no contest to one count of reckless homicide.
Court records show Emerson entered the plea Friday morning. A judge then convicted him and ordered a presentence investigation, with sentencing scheduled for February 28th.
He’s one of three men accused of beating 61-year-old Donald Mitchell Jr in a downtown Stevens Point parking lot. Investigators say the group was rummaging through Mitchell’s vehicle to steal valuable items. When Mitchell confronted the group, they beat him and left him in the parking lot.
He was rushed to a local hospital and airlifted to Wausau, where he died the next day. Doctors said he showed significant injuries including broken ribs. Nearly every bone in his face was broken as well.
Emerson faces up to 46 years in prison at sentencing; 40 years for the homicide count and an additional six years due to Mitchell’s age.
Two others have faced charges in connection with the incident. Arlin Sangster was sentenced to 20 years in prison after being found guilty at trial last fall. Brandon Boehm will return to court on February 7th for a plea hearing.
All three men were from the Wausau area.
