MERRILL, WI (WSAU) — The teen accused of lashing out at correctional officers at the Lincoln Hills Youth Prison, leading to the death of Corey Proulx, will be in court on Monday as his defense team tries to move the case out of adult court.
Records indicate that attorneys for Javairus Hurd have filed for a reverse waiver hearing, saying it’s unconstitutional to try the 17-year-old as an adult.
A motion to dismiss the original adult court jurisdiction was filed on December 30th.
Hurd faces one count of reckless homicide and two counts of battery by prisoners. Investigators say he threw a cup of soap in the face of a female officer as he was returning from outdoor recreation time. He then walked away but was chased by Proulx, who tried to restrain him. Hurd allegedly lashed out, causing Proulx to fall over and hit his head on a hard surface.
The 49-year-old was rushed from the scene to a local hospital where he was declared brain dead.
Hurd was 16 at the time of the incident but the case was immediately filed in adult court due to the severity of the charges. He is jailed on a $100,000 bond and faces up to 72 years in prison if found guilty at trial.
The reverse waiver hearings will be held in early February.
