STEVENS POINT, WI (WSAU) — A Portage County man will serve eight years in prison after no contest to a count of operating a vehicle while under the influence of a controlled substance.
Eugene Volk entered the plea on Thursday as part of a deal with the state to dismiss two additional felony counts related to the case. In addition to eight years in prison, he will also serve five years on extended supervision. He will also pay court costs and fines.
Volk was caught driving outside his allowed hours in January. When officers caught up to him, they noticed signs of impairment.
The 67-year-old reportedly admitted to having one drink before driving. A search of his vehicle turned up three beer cans.
Volk initially refused to pull over and told officers there was no probable cause to stop him, which led to misdemeanor charges for obstructing an officer. That was dismissed outright as part of the deal.
He was given credit for 292 days already served in jail.
Previous charges against him date back to 1990 and include three offenses in Arizona. His most recent conviction came in 2018.
