The 53-year-old was found passed out in his vehicle last June. Officers approached his vehicle near the intersection of Marsh Road and Elm Road in Portage County and immediately noticed the strong smell of alcohol. A bottle of vodka was found in the center console. He blew a .24 on a breathalyzer, three times the legal limit for driving.
Terms of his sentence also include $4,220 in fines and absolute sobriety from alcohol. He will also have his driver’s license revoked for three years. He will be eligible for the earned release program towards the end of his sentence.
Nieman was given credit for 270 days already served in jail. He had faced up to 12.5 years in prison on the charge.
