WISCONSIN RAPIDS, WI (WSAU) — A former Wisconsin Rapids man accused of killing Benny Scruggs in 1985 is now scheduled for a competency hearing as he faces one count of murder.
Donald Maier made a court appearance on Tuesday where Judge Todd Wolf ordered the competency evaluation after a series of statements by the defendant. That included a request from Maier to waive his attorney and continue the case pro/se, or serving as his own attorney.
Attorney Timothy Hogan, who has been representing Maier, said he was unaware of Maier’s desire to relieve him of his duties. Judge Wolf then ordered the competency hearing before the case goes any further.
No further court action was immediately scheduled.

The 60-year-old is accused of killing Scruggs by breaking into his trailer home and stabbing him. Maier has been serving prison time on an unrelated stalking charge, but according to some of his fellow inmates at the Racine Correctional Institute he admitted to them that he committed the crime and that he had been having an affair with Scruggs’ wife.
