CONLEY COMMENTARY (WSAU) – I have no law degree, but even I can see how the Colorado Superme Court embarrassed itself this week.
Guilty before trial. That’s how they treated Donald Trump in their ruling to keep him off the state’s primary ballot.
Every one of the court’s 7 justices were appointed by democrats. The lawsuit, filed by random voters who claim that Trump is an insurrectionist and is therefore ineligible, is funded by George Soros money. And the court, fully aware that Trump is facing criminal charges related to the January 6th capital riots, could not possibly wait until a jury renders its verdict.
The timeline of the Trump trial doesn’t coincide with the agenda of keeping Trump off the ballot. In Colorado, ballots will be printed on January 5th. The Trump trial will come long after that. So, of course, Donald Trump is guilty of being an insurrectionist before his trial, not after.
“Innocent until proven guilty” is the most basic underpinning of our legal system. How could four justices on a state Supreme Court get that so wrong? Their ruling calls the 14th amendment of the U.S. Constitution “self executing,” so they don’t have to wait for a jury to weigh in. They themselves, without hearing from any witnesses or weighing any testimony, get to decide themselves if Trump was part of an insurrection. The evidence from January 6th does not support their conclusion. Donald Trump did not complete his speech that day before people began entering the Capitol. There is no one who heard Trump speak that day and then teleported themselves across the National Mall. Even if they did, they would have heard the President say that they were to march “peacefully and patriotically” over to Capital Hall.
The U.S. Supreme Court is certain to reverse this decision. The only question is whether the three liberals on the court, Sonya Sotomayor, Alana Kagen, and Kentanji Brown-Jackson, can abide such nonsense.
The strategy of Trump’s opponents is quickly being revealed. Millions of voters must be denied their preferred choice in the 2024 election… because he just might win.
