APPLETON, WI (WSAU) – A second attempt is being made by convicted killer Steven Avery, star of Netflix’s hit documentary “Making a Murderer,” to obtain a new trial.
Avery was found guilty and given a life sentence alongside his nephew Brendan Dassey in 2005 for raping and killing Teresa Halbach in Manitowoc County.
According to police reports, Halbach went to the Avery Salvage Yard in Mishicot to take pictures of cars for a magazine that sold cars. It was reported soon after that Halbach was missing and on November 5, 2005, her RAV-4 was discovered at the Avery Salvage Yard along with pieces of human bone in a burn pit.
In Avery’s most recent court submission, which was issued Tuesday in the Court of Appeals, District 2, Avery’s counsel claims that the court relied on misleading facts and misapplied the law, notably its interpretation of the “Denny Standard” for admitting third-party evidence.
His counsel argued that the integrity of the forensic evidence used against him as well as the prosecution’s primary witness should be called into question by recent material involving a third-party suspect.
