Senior Counsel for Mountain States Legal Foundation Jim Kerwin joined me on the Meg Ellefson Show this morning to discuss a precedent-setting lawsuit against DEI and the discriminatory practices of his client’s employer, the Oregon Department of Environmental Quality.
His client, Danielle Johnson bravely took a stand and merely questioned their racist DEI practices and was called a racist in an all-company email, had her pay cut and was demoted. She was also told that she was “under investigation.”
She asked in a meeting if it was “legal for a government employer such as the Department of Environmental Quality to discriminate on the basis of race, to give people a preference in employment because of their race?”
Johnson said that employees were told that being “white is automatically to have all kinds of moral failing” and to be told that “white people can’t be empathetic” because they don’t have “real life experiences” like non-whites do.
“That’s just one among many, many, many messages that she heard constantly for years,” Kerwin said. She saw that “her employer was not only just sending messages stating to be white is to be inferior, but also taking action on those views and giving other people preferences in employment because they were non-white.”
Kerwin advised: “When these DEI practitioners do this stuff, they attempt to use language that they think will shield them from the legal consequences. So for example, they’ll say in a meeting, you are now instructed to elevate the voices of people of color in your meeting.”
I can’t even imagine what this woman continues to be subjected to from her employer and co-workers. From the head of the agency calling her a racist, demoting her, cutting her pay and denying her opportunities for promotions, to enduring the ongoing daily stress and stigma in her workplace. Prior to her pointing out these DEI policies were inherently racist, she (and her co-workers) had been subjected to these DEI messages for years.
Whether it stands for “Didn’t Earn It” or As Florida Governor Ron DeSantis said: “Discrimination, Exclusion and Indoctrination,” the key thing to remember is if these DEI policies were implemented to favor whites ONLY, it would be immediately deemed racist.
This is one of the many hills that the left will DIE on.
These are policies embraced by Democrats and we must call them out for their divisive and racist behavior and to hold them accountable for the pain that they’ve imposed on others.
