CHIPPEWA FALLS, WI (WSAU) — A Chippewa County judge will decide if the taped confession of Carson Peters-Berger will stand as evidence in the pending homicide case against him.
The teen is accused of killing Lily Peters in the spring of 2022. Police recorded him confessing to the crime shortly after the incident, though his defense team says that tape shouldn’t be allowed at trial.
The defense’s argument centers on Peters-Berger’s autism diagnosis, questioning whether he understood the significance of the interrogation. They are also arguing whether he was aware that he could leave the questioning at any time.
Both sides argued their case on Tuesday. Judge Steven Gibbs is expected to provide a written decision on the issue this summer.
The 17-year-old is facing intentional homicide charges and is being tried as an adult, even though he was 14 at the time of Peters’ death. His defense team tried unsuccessfully to move the case to the juvenile system, a motion that was denied one year ago.
He faces a mandatory life sentence if found guilty at trial.
