WAUSAU, WI (WSAU) — A Wausau man has reached a plea deal with prosecutors for shooting and killing his friend during a night of drinking.
David Anselmo entered a guilty plea on Tuesday of homicide by intoxicated use of a weapon after accidentally firing a handgun that was being passed around at a party. The round struck and killed 19-year-old Trey Wilcox.
According to Anselmo he was examining the gun to see if it had a bullet in the chamber, as he was pulling the slide back, his hand slipped and his finger accidentally pulled the trigger.
The magazine was taken out of the weapon at the time of the shooting.
In exchange for the guilty plea a count of operating a firearm while intoxicated will be dismissed but read into the record. A sentencing date was not immediately set, though Judge Gregory Huber did order a presentence investigation and set a calendar call for February 8th.
Anselmo had initially been charged with first-degree reckless homicide in the case.
