WISCONSIN RAPIDS, WI (WSAU) — Monday’s sentencing for the man found guilty of killing Eleanore Roberts in 1984 has been delayed.
Court records show one of John Sarver’s attorneys, Jeremiah Wolfgang Meyer-O’Day, was unable to make it to Wisconsin Rapids for the hearing. He was busy representing another client at another trial.
That forced Monday’s hearing to be switched from sentencing to a status conference at the last minute. All attorneys involved appeared via phone.
The sentencing was rescheduled for February 17th. Sarver faces a mandatory life sentence with only the possibility of parole to be discussed.
He was found guilty last fall of killing Roberts in her home outside Wisconsin Rapids. Prosecutors used DNA evidence found on a ski mask near the crime scene along with a palm print found near where he body was discovered to link him to the incident. Though his defense team argued that if the case against him were solid, he would have been tried years ago.
The 59-year-old will remain jailed on bond until the new sentencing date.
