STEVENS POINT, WI (WSAU) — A Fox Valley man behind the wheel for a deadly crash last November will go to trial on one count of operating a vehicle without a valid license- causing a death.
Axel Crus-Zelaya was in court on Monday where he waived his right to a preliminary hearing. Judge Louis Molepske then bound him over for trial.
Officers say the 30-year-old was driving when his vehicle rolled along US Highway 10 near Amherst Junction in Portage County. The car flipped and landed upright, killing one of the passengers.
Cruz-Zelaya was initially cited for overdriving the conditions but officers later recommended felony charges against him. Speed and snowy conditions were factors in the crash.
Molepske had previously entered a not guilty plea on Curs-Zelaya’s behalf, as the defendant has been working through an interpreter for the pre-trial procedures thus far.
A pretrial conference is scheduled for March 20th. No trial date has been set. Crus-Zelaya faces a maximum penalty of six years in prison and $10,000 in fines if he’s found guilty.
