CHIPPEWA FALLS, WI (WSAU) — A filing deadline is approaching for the legal teams involved in the case against the boy accused of killing Lily Peters.
Both sides must file their responses to each other’s briefs by Friday, according to a decision handed down by Judge Steven Gibbs back in August.
The boy’s defense team has petitioned the court to move the case to the juvenile system. But the state insists that the case should remain in circuit court. Judge Gibbs is expected to make a final decision on the request early next year.

The boy’s defense team has tried to argue that the suspect, known by the initials CPB, may have an autism spectrum disorder which could impact his ability to comprehend the consequences of his actions. Prosecutors have pointed to the violent way that Peters was killed, saying a move to juvenile court would diminish that.
So far the boy has only been identified by his initials C.P.B. Should the case be moved to adult court, his full name would be released.
Peters was killed as she was riding her bike home from her aunt’s house. C.P.B. was accompanying her on a hoverboard, investigators say he asked her to “go explorign” off the path they were on, then beat her and sexually assaulted her. When he learned that she had been reported missing, officers say he returned to the area to try to hide her body better.
The boy faces three felony counts including one for intentional homicide. If he’s foudn guilty in adult court he would face a mandatory life sentence.
