MERRILL, WI (WSAU) — The Madison teen accused of beating a correction officer at the Lincoln Hills Youth Prison will appear in court this afternoon.
Javarius Hurd waived his right to a preliminary hearing and a speedy trial during Friday’s appearance but did not enter a plea. The 16-year-old is accused of assaulting a female correction officer after he returned from outdoor recreation time. He then walked away but was chased down by a male correction officer, Corey Proulx.
Hurd is then accused of beating the 49-year-old as he tried to restrain him. Proulx fell and struck his head on a concrete surface. He was rushed from the scene to a local hospital, where he was declared brain-dead the next day.

Hurd is accused of planning the attack because he thought the female officer was unfair to him. She was treated and released for her injuries.
Charges against him include reckless homicide and felony murder under special circumstances. Two counts of battery by prisons are also included. Three of four charges carry a combined maximum sentence of 37 years in prison. The felony murder count is currently an unclassified felony with no set minimum or maximum sentence.
Further court action is scheduled for August 23rd. Hurd’s cellmate, Rian Nyblom, is also facing felony counts for helping him plan the attack. He returns to court on August 1st.
