MINOCQUA, WI (WSAU-WAOW) – Kirk Bangstad and the Minocqua Brewing Company were granted an emergency business injunction to remain open by the Wisconsin District Court of Appeals on Thursday.
The Oneida County Zoning Board voted on Wednesday to revoke the brewery’s ability to operate because they refused to comply with requirements needed to receive a conditional use permit to construct an outdoor beer garden. The Oneida County Board had directed the brewing company to cease offering outdoor seating for ninety days last month. Bangstad objected and filed an appeal, which was initially turned down by Oneida Co. Corporation Counsel Mike Fugle in June.
“The continued non-compliance will demonstrate to the public opinion at large that the zoning laws are, as it were, toothless if someone just chooses not to comply,” Fugle said before handing down his decision.
To get authorization to build an outdoor beer garden, the brewery was instructed by the county to become ADA-compliant, add four conventional parking places, and develop a new stormwater management plan.
