WASHINGTON D.C. (WSAU) – A $100 million lawsuit is expected to be filed by former President Donald Trump against the Justice Department over the government’s raid on his Mar-a-Lago estate in Palm Beach, Florida, in 2022.
Fox News reported on Tuesday morning that Trump’s lawsuit claims that the raid was carried out with a “clear intent to engage in political persecution.” As a result, Special Counsel Jack Smith charged the former president with 37 felonies, including conspiracy to obstruct justice, willful retention of information related to national defense, and making false statements to which he pleaded not guilty.
Smith’s charges against Trump were dismissed by US District Judge Aileen Cannon last month after she referenced the Appointments Clause of the Constitution to declare that Smith had been improperly funded and appointed.
“What President Trump is doing here is not just standing up for himself; he is standing up for all Americans who believe in the rule of law and believe that you should hold the government accountable when it wrongs you,” Trump Attorney Daniel Epstein said during an interview with Fox Business’ Lydia Hu.
Epstein further argued that the DOJ, along with Attorney General Merrick Garland, decided to raid Trump’s home not based on “social, economic, and political policy” but was in “clear dereliction of constitutional principles, inconsistent standards as applied to” Trump, and a “clear intent to engage in political persecution—not to advance good law enforcement practices.”
The memo includes a certification signed by Trump stating Epstein is his legal counsel for the notice to the Justice Department. The Justice Department refused to comment.
