WAUSAU, WI (WSAU-WAOW) — A Hatley man accused of killing his three-month-old son will face trial in October.
Brock J. Birkholz, 27, initially faced charges of first-degree reckless injury in November 2024, but those charges were elevated to first-degree intentional homicide after an autopsy was conducted.
According to the criminal complaint, Birkholz claimed the baby choked while he was feeding him a bottle and then went limp. Birkholz said he performed CPR and called 911.
Medical experts at the hospital, however, attributed the cause of death to head trauma and noted multiple bruises on the child’s body.
Birkholz is currently held in Marathon County Jail on a $300,000 cash bond. On January 13, court records show his bond was amended to permit supervised visits with one person, provided a physical glass barrier is in place, and there is no physical contact. He is prohibited from contacting minors under the age of 12.
A pre-trial conference is set for Next Wednesday, January 28. The jury trial is scheduled to commence on October 26, lasting five days.
